What happens to applications?

Freedom of Information Annual Report  2010/11

The most common reason for closing a case without investigation is because the applicant did not request a review before appealing to the Commissioner – accounting for 39% of all such cases in 2010/11.  This is up from 29% the year before. Authorities must advise requesters of their right to request a review – something the Commissioner consider during his practice assessment visits.

The number of cases closed with decision increased by 47%, from 179 cases closed in 2009/10 to 263 in 2010/11.  This is mainly down to the nature of the applications we received over the year, which were less likely to be settled during investigation.  Fewer decisions were issued wholly in favour of either applicants or authorities –“partially upheld” cases accounted for 46% of all cases closed with decision in 2010/11 compared to just 28% the year before.
