This guidance sets out what Scottish public authorities’ responses to information requests should contain to be compliant with FOISA and the EIRs.

The references in the body of the guidance are mainly to FOISA.  The additional points that should be considered under the EIRs are contained in the footnotes. 

This document is intended as a quick reference guide and should be read in conjunction with other SIC guidance at: FOI law in Scotland and the Scottish Ministers’ Code of Practice on the Discharge of Functions by Public Authorities under the Freedom of Information (Scotland) Act 2002 available on the  Scottish Government website

Further guidance on the EIRs is available in our section on the Environmental Information (Scotland) Regulations 2004. This includes guidance on how to decide whether a request is for environmental information.
