33. Commercial interests and the economy

  1. (1)
    Information is exempt information if-
    1. (a)
      it constitutes a trade secret; or
    2. (b)
      its disclosure under this Act would, or would be likely to, prejudice substantially the commercial interests of any person (including, without prejudice to that generality, a Scottish public authority).
  2. (2)
    Information is exempt information if its disclosure under this Act would, or would be likely to, prejudice substantially-
    1. (a)
      the economic interests of the whole or part of the United Kingdom; or
    2. (b)
      the financial interests of an administration in the United Kingdom.
  3. (3)
    In subsection (2), "administration in the United Kingdom" has the same meaning as in section 28(2).
