Step 1: Request is received

Is the request valid under s8 of FOISA?

  • If the request is not valid, use the duty to advise and assist the applicant (s15) to explain how to make a valid request.
  • If the request is valid, issue a response (see step 2).

Remember that information requests under the EIRs can be made verbally.

Is it clear what information the applicant wants?

  • If not, ask the applicant for clarification as soon as possible.
  • Once the clarification is received, issue a response (see step 2).
  • Where you need to seek clarification, you have 20 working days from receipt of the clarification – not receipt of the original request – to reply.
