Section 10: Complaints

The Commissioner's aim is to make the Commissioner's publication scheme as user-friendly as possible, and we hope that you can access all the information we publish with ease.  If you do wish to complain about any aspect of the publication scheme, however, then please contact us, and we will try and resolve your complaint as quickly as possible.  You can contact:

Any complaint will be acknowledged within two working days of receipt and we will respond in full within twenty working days.

You have a legal right to access information under this scheme.  This right applies only to information requests made in writing* or in another recordable format.  If you are unhappy with the Commissioner's responses to your request, you can ask the Commissioner to review his response. Any request for review will be dealt with by another member of staff who will thoroughly consider the reasons for your dissatisfaction and provide you with a full written response. You should be aware, however, that if you are unhappy with the outcome of the Commissioner's review, you cannot ask the Commissioner to investigate the matter further.  If you are unhappy with the service which has been provided to you by the Commissioner's office, you can contact the Scottish Public Services Ombudsman, who provides a 'one-stop-shop' for individuals making complaints about organisations providing public services in Scotland.

The Commissioner's website has a guide to the process of requesting information from public authorities under FOISA, and he operates an enquiry service on Monday to Friday from 9:00am to 5:00pm.  His office can be contacted as follows:
