Deemed or mute refusals. - At one point 62% of complaints to the Ombudsman arose from deemed refusals (i.e. failure to reply) He issued a report card on Government department grades A-D + Fail. The number of complaints for deemed refusal has fallen to 15% of volume.

Users of FoI provisions in Canada : 50% people; 40% business. 5% media; 5% MPs.

Record Keeping - investigations may entail a 2 nd or 3 rd search for relevant documents and generally produce 15% more in the way of documents valid and relevant to the request.

Need for an Information Law - 'active consideration should be given for an information law which dictates the circumstances and manner in which a record has to be created.'
