The 1992 Constitution of Brandenburg included a fundamental right to information. This was transposed into a 1998 Freedom of Information Act. Only 3 other Laender have followed suit - the other 11 are awaiting a Federal Act (which is not forthcoming.)
The Commissioner for Access to Information has attempted to reduce the number of exemptions but unsuccessfully. He notes 'Once you have an extensive list of exceptions in the law it is extremely difficult to convince the legislature to shorten it later. Sometimes, even, the forces who try to put back the clock grow stronger and one is busy defending the present level of transparency.'
Public utilities e.g. public transport are outside the scope of the access laws if run as private but state owned companies.
