Enforcement Notices
The Commissioner has powers to issue Enforcement Notices to compel authorities to take steps to comply with a breach of FOI law.
When an authority receives an Enforcement Notice it must comply within the stated timescale (a minimum of 42 days). If the authority does not comply, the Commissioner may refer the matter to the Court of Session.
The Commissioner issues many fewer Enforcement Notices than Decision Notices (formal notices on FOI appeals).
