Commissioner's response to FOI extension consultation

The Scottish Ministers are currently considering whether there is a need to extend the Freedom of Information (Scotland) 2002 to additional organisations. The Commissioner's response to the Scottish Government's consultation on this issue is available below.

In his response, the Commissioner highlights a range of organisations as appropriate for further consideration by Ministers. These include:

  • Health and social care services provided under contract to Scottish public authorities
  • Services provided under Private Finance Initiative (PFI) / Public Private Partnership (PPP) / Non-Profit Distributing (NPD) contract arrangements
  • HubCos and services provided under contract through the hubCo model
  • Transport services provided on behalf of Scottish public authorities

The Commissioner's response also includes comment on the scope of the current consultation and the potential impact of FOI for organisations.
